چکیده
Eser sözleşmesinde, genel kuraldan farklı olarak, yüklenicinin bizzat ifa yükümlülüğü bulunmaktadır. sözleşmesinde borcu, TBK m. 471/III’te düzenlenmektedir. Ancak bu mutlak bir kural olarak düzenlenmemekte; eserin kendi yönetimi altında yaptırılabileceği de öngörülmektedir. Eserin meydana getirilmesinde kişisel özellikleri ve becerisi bakımından önemli değilse eseri getirme borcu olmaz. Bu halde yüklenici getirilmesi sırasında üçüncü kişilerden yararlanabilir. Bunlar yardımcı kişiler olabileceği gibi alt yükleniciler olabilir. Çalışmada işin hangi aşamalarında kişiden yararlanabileceği, kişinin ifaya katılmasının kapsamda olması gerektiği bunlara dayalı sonuçlar, eser sözleşmesi özelinde ele alınmaktadır. çalışma ile kişi tarafından edilmesi sadece kişiyi katması değil, alacaklının iradesine ifanın yapılması sonuçları da yine sözleşmesine özel incelenmiştir. Bir olasılık kişinin, alacaklı ya borçlunun iradesi olmaksızın, inisiyatif alarak getirmesi hali değerlendirilmiştir. Ayrıca son durum icra kanalıyla kişiye yaptırma irdelenmiştir.
